What is included in an employee's vocational review? An employee's basic check is a review of a person's business records, criminal records, employment, and / or financial records. Most employers do background checks on job candidates. Some employers perform inspections after hiring an employee.

When employers use a third party to check someone else's status, the Credit Reporting Rights Act (FCRA) limits what they are allowed to watch, and how. The FCRA is a federal law that sets standards for investigations into employment. FCRA defines background checks as a consumer report.

How Employers Make Natural Checks
Before an employer makes a baseline review of you (which FCRA defines as a consumer report), they must notify you in writing and obtain your written consent.

However, if the employer conducts the inquiries on their own (instead of receiving a report through another company), it is not legal to ask for your consent. For example, they do not have to get your permission to call your former employer. They only need to notify you if they are going to use a third-party employment survey company.

If the employer decides not to hire you because of a consumer report, or decides to terminate the job offer, he or she must give you a "bad deal." This includes a copy of the consumer report and a description of your rights.

They must then give you a "bad action statement" stating that they have decided not to hire you and to inform you of the employment company contact information they used. This will also include information on your right to dispute the report.
